Residential Seller's Property Disclosure Statement (SPDS)

The seller's written disclosure of known property conditions — one of the most important documents a buyer receives in any Arizona real estate transaction.

What Is This Document?

The Residential Seller Property Disclosure Statement — commonly called the SPDS (pronounced "spuds") — is the form a seller uses to disclose known material facts about the property. It covers a wide range of topics including the physical condition of the structure, roof, plumbing, electrical, HVAC, pool, and other systems, as well as legal issues, HOA matters, environmental concerns, and neighborhood conditions.

The SPDS is completed by the seller to the best of their knowledge. It is not a warranty and does not replace a professional inspection — but it is a critical starting point for understanding what the seller knows about the property.

For horse property and acreage buyers, the SPDS sections covering water source, well condition, septic systems, zoning, and agricultural use are especially important. These sections can reveal issues that would not be apparent from a standard home inspection.

Straight Shooter Tip

Read the SPDS carefully — and read between the lines. Blank answers, vague responses, or "unknown" on questions about the well, septic, or water source on a rural property are red flags worth investigating. The SPDS tells you what the seller knows. Your inspection tells you what is actually there. You need both.
