What Is This Document?
The Domestic Water Well and Water Use Addendum is used when a property is served by a private domestic well rather than a municipal or private water company. It addresses the condition of the well, the pump, and related equipment; the well's water production capacity; water quality testing; and the buyer's right to conduct inspections and testing during the due-diligence period.
In Arizona, water rights are complex and vary significantly depending on the type of well, the groundwater basin, and the intended use of the water. A domestic well permit typically allows water use for household purposes and limited irrigation — it does not automatically convey the right to irrigate large acreage or fill stock tanks for commercial livestock operations without additional rights.
For horse property buyers, understanding the well's capacity and water rights is critical. Horses require significant water — a single horse can drink 10 to 15 gallons per day, and irrigated pasture requires far more. A well that is adequate for a household may not be adequate for an equestrian operation.
